1. Who we are
EasyCOSHH (the “Service”) is operated by Spire Trade Advisors Ltd, a company registered in England and Wales (company number 16562883), registered office 9 Soapworks House, Carrack Mews, London, England, E16 2EN (“we”, “us”). Contact: support@easycoshh.co.uk.
2. Business customers only
The Service is for businesses and other organisations, not consumers. By buying, you confirm you are acting for a business, trade or profession.
3. What we provide
An online tool that turns information you provide (including text read from a Safety Data Sheet you upload) into a draft COSHH assessment document in PDF and Word format (an “Assessment”). Assessments are generated automatically by rules based on published HSE guidance, including the COSHH essentials approach. They are not reviewed by a person.
4. Not professional advice
We are not health and safety consultants, occupational hygienists or lawyers, and nothing in the Service is professional advice. You, as the employer, remain responsible for complying with the Control of Substances Hazardous to Health Regulations 2002 and other law. You must check each Assessment against the supplier’s current Safety Data Sheet and the actual work, correct and adapt it, and sign it off before relying on it. The Service is not a substitute for a competent person, and you must use one for high-risk substances or activities, including carcinogens, mutagens, reproductive toxins, respiratory sensitisers (such as isocyanates), asbestos, lead, respirable crystalline silica and work in confined spaces. We may flag such cases, but we do not guarantee we will detect them.
5. Accuracy of information
Assessments depend on the information you give us and on the quality of the Safety Data Sheet. Automatic text extraction can miss or misread information. You are responsible for checking every part of the Assessment. We do not guarantee that an Assessment is complete, accurate or “suitable and sufficient” for your workplace.
6. Prices and payment
After any free assessments (clause 6A), a single Assessment costs £2.99. You can instead buy credit in £5, £10 or £20 top-ups; each Assessment then costs 99p, deducted from your balance. Not VAT registered: prices shown are final, no VAT is added. Payments are processed by Stripe; we do not receive or store your full card details. A contract is formed when we confirm your payment.
6A. Free assessments
When you create an account by confirming your email address with a one-time code, we add 5 free assessments to your account. Free assessments are full downloads, identical to paid ones, and are used before any paid credit. The free allowance is available once per person and per email address; we treat addresses that differ only by “+” tags or (for Gmail) dots as the same address, we do not grant it to disposable or temporary email addresses, and we limit how many allowances can be claimed from one connection. We may withdraw free assessments obtained in breach of these rules. We may change or end the free offer for new accounts at any time; free assessments already added to an account remain usable while the Service runs. Free assessments have no cash value. Clauses 4, 5 and 11 apply to free assessments in the same way as paid ones.
6B. Max plan (monthly subscription)
The Max plan costs £29.99 per month and lets you create up to 100 Assessments in each monthly billing period. The allowance resets at the start of each billing period; unused Assessments do not roll over. The plan starts when you pay and renews automatically every month at the then-current price, charged to your payment method, until you cancel. We will tell you at least 30 days before any price change. You can cancel at any time from your account (“Manage or cancel plan”), which opens Stripe’s billing page; cancellation takes effect at the end of the current billing period, you keep access until then and you will not be charged again. Payments already made are not refunded except under clause 9 or where the law requires. Logo branding (your logo and company name in the document header) is included on Max plan and free Assessments; Assessments bought singly or with credit have a plain, unbranded header. You confirm you have the right to use any logo you upload, and you can remove it at any time. While a Max plan is active, Assessments use the plan allowance before any free assessments or credit.
7. Credit
Credit is linked to the email address used at checkout and can be used by signing in with a one-time code sent to that address. Keep access to that mailbox secure: anyone who can read it can use the credit. Credit has no cash value, is not transferable and is non-refundable except as set out in clause 9 or where the law requires. If we close the Service, we will give at least 30 days’ notice and refund any unused credit balance.
8. Licence
On payment, you may use, copy and adapt your Assessment for the internal purposes of the organisation named on it. You must not resell the Service’s output as templates, or use the Service to create a competing product.
9. Delivery, faults and refunds
Assessments are digital content made available immediately after payment and emailed to you. If a file is corrupted, fails to generate or materially differs from its description, tell us within 30 days and we will fix it, re-supply it or refund the price paid. Because Assessments are delivered immediately, we do not otherwise give refunds for change of mind.
10. Acceptable use
Do not upload material you have no right to use, malware, or personal data that isn’t needed for the Assessment. Do not misuse, overload or try to circumvent payment for the Service.
11. Liability
Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot lawfully be limited. Subject to that, we are not liable for loss of profit, business or goodwill, fines or penalties, or indirect or consequential loss, and our total liability arising from an order is limited to the amount you paid for that order. You are responsible for the health and safety decisions you make, and for how you use the Assessment.
12. Privacy
We use personal data as described in our Privacy Policy.
13. Changes
We may update these Terms. The version you accepted applies to your order.
14. Governing law
These Terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
